Is this safe?

Hello. There is this really old videogame made in 2008, with a song that I am obsessed with (it's just instruments no words). The video game itself is extremely underated. I really really want to put it in one of my tic toc videos. But, do not want to risk a copywrite. Is there any safe way to do this??
