Appeals?
I am told this is the place to post.
My employer filed a LMIA for me on May 23th low-wage in Ontario dual intent.
He got an email from a Officer last week to do an interview. The interview came and it didn't go good...
The officer said that they chose the wrong NOC. They had a problem with me being a NOC 63200 Cook because I work at an A&W and they said that NOC 65201 makes more sense to them even though I don't work at the counter and just simply cook meals.
They sent my employer an email asking them for more info after and they answered but we recieved the LMIA which says that I'm NOC 65201 and don't qualify for dual intent and also that there was no labour shortage.
I'm very unhappy about this after waiting almost a year. I don't work at the food counter and I think that the officer was biased because of my work location. I asked my consultant and he said that he is going to write a letter to ask the supervisor to review the lmia because the officer was biased in their judgment.
I was wondering if this has worked for anyone? I want to appeal but I'm not sure if it's worth doing since it seems like us foreign students are just dirt to Canadians.
